Welcome to CyberCharge24. These Terms of Service ("Terms") govern your access to and use of the CyberCharge24 electric vehicle charging network, mobile applications, websites, and related services (collectively, the "Services") provided by CyberCharge24 ("we," "our," or "us").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

IMPORTANT NOTICE

These Terms contain an arbitration agreement and class action waiver that affect your legal rights. Please read Section 11 carefully.

1. Acceptance of Terms

By creating an account, accessing our charging stations, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and through our mobile application. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

2. Service Description

CyberCharge24 provides a network of electric vehicle charging stations powered by Tesla V4 Supercharger technology. Our Services include:

  • Access to publicly available EV charging stations in Texas
  • Mobile application and website for locating stations, initiating charging sessions, and managing your account
  • Payment processing for charging services
  • Customer support and assistance
  • Real-time station availability and status information

CyberCharge24 currently operates exclusively in the state of Texas. We make no representation that our Services are available or appropriate for use in other locations.

Disclaimer: CyberCharge24 is an independent company and is not affiliated with, endorsed by, or sponsored by Tesla, Inc. While we utilize Tesla V4 Supercharger technology at our stations, we operate independently and are solely responsible for our Services.

3. Account Registration and Security

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Immediately notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may not transfer your account to another person or use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Acceptable Use

When using our Services, you agree to:

  • Comply with all applicable federal, state, and local laws and regulations
  • Use charging stations only for their intended purpose of charging electric vehicles
  • Not occupy a charging station after your vehicle has completed charging
  • Not damage, vandalize, or tamper with charging equipment
  • Not interfere with other users' ability to access charging stations
  • Follow all posted safety instructions and warnings
  • Not use the Services for any illegal, fraudulent, or harmful purposes

Prohibited Activities

You may not:

  • Attempt to gain unauthorized access to our systems or networks
  • Use automated systems (bots, scrapers) to access the Services
  • Resell or commercially exploit the Services without our written permission
  • Reverse engineer, decompile, or disassemble any software or technology
  • Transmit viruses, malware, or other harmful code
  • Impersonate another person or entity
  • Harass, threaten, or harm other users or our staff

5. Payment Terms and Fees

By using our charging Services, you agree to pay all applicable fees and charges.

Pricing

Charging fees are calculated based on the amount of electricity consumed (kWh) or time spent charging, as displayed at each station and in our mobile application. Prices may vary by location, time of day, and demand. All prices include applicable taxes and fees.

Payment Methods

We accept major credit cards, debit cards, and other payment methods as indicated in our mobile application. By providing payment information, you authorize us to charge your selected payment method for all fees incurred.

You are responsible for maintaining valid payment information on file. If a payment fails, we may suspend your access to the Services until payment is received.

Refunds and Disputes

All charges are final and non-refundable unless we determine, in our sole discretion, that a refund is warranted due to:

  • Equipment malfunction or service failure
  • Billing errors or duplicate charges
  • Other exceptional circumstances

Refund requests must be submitted within 30 days of the charge via email to info@cybercharge24.com.

Idle Fees

To ensure fair access to charging stations, we may charge idle fees if your vehicle remains connected to a charging station after charging is complete. Idle fees will be clearly communicated through our mobile application.

6. Vehicle Compatibility and Safety

You are responsible for ensuring that your electric vehicle is compatible with our charging equipment. Our stations support NACS, CCS1, and CCS2 charging standards, but we make no guarantee that all electric vehicles will be compatible.

You acknowledge that:

  • You assume all risk associated with charging your vehicle
  • We are not responsible for damage to your vehicle resulting from normal use of our charging equipment
  • You will immediately discontinue use and report any equipment malfunctions
  • You will not leave your vehicle unattended if you observe any safety concerns

In the event of equipment damage caused by misuse or negligence, you may be held financially responsible for repair or replacement costs.

7. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, software, and design, are owned by CyberCharge24 and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not:

  • Copy, modify, or create derivative works of our content
  • Use our trademarks, logos, or branding without written permission
  • Frame or mirror any portion of the Services
  • Use data mining, robots, or similar data gathering tools

8. Privacy and Data Collection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to our collection and use of your information as described in the Privacy Policy, including location data, charging session information, and payment details.

9. Disclaimers and Limitation of Liability

Service Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Charging stations may be unavailable due to maintenance, technical issues, power outages, or other circumstances beyond our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERCHARGE24 AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Vehicle damage resulting from normal use of charging equipment
  • Delays or failures in charging services
  • Unauthorized access to your account or personal information

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO CYBERCHARGE24 IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless CyberCharge24 and its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services
  • Violation of these Terms or any applicable law
  • Violation of any third-party rights
  • Damage to charging equipment caused by your negligence or intentional misconduct
  • Any disputes with other users

11. Dispute Resolution and Arbitration

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

This section affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims. It contains procedures for mandatory binding arbitration and a class action waiver.

Informal Dispute Resolution

Before filing a claim, you agree to contact us at info@cybercharge24.com to attempt to resolve the dispute informally. We will work in good faith to resolve your concerns within 60 days.

Binding Arbitration

If we cannot resolve a dispute informally, you agree that any claim, dispute, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

The arbitration will be conducted in Texas. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND CYBERCHARGE24 INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED PROCEEDING.

Exceptions

Either party may bring a claim in small claims court if it qualifies. Additionally, claims related to intellectual property infringement may be brought in court.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if:

  • You violate these Terms or our policies
  • You engage in fraudulent or illegal activity
  • Your payment method fails or you have outstanding charges
  • We cease operations or discontinue the Services

You may terminate your account at any time by contacting us at info@cybercharge24.com. Upon termination:

  • Your right to access and use the Services will immediately cease
  • You remain responsible for any outstanding charges
  • Certain provisions of these Terms will survive termination, including payment obligations, disclaimers, limitations of liability, and dispute resolution

13. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CyberCharge24 regarding the Services and supersede all prior agreements and understandings.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or successor entity.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, power outages, government actions, or labor disputes.

Acknowledgment

By using CyberCharge24's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that these Terms constitute a legally binding agreement between you and CyberCharge24.
